This policy explains how Martyn Gregory Gallery ("we", "us", "our") collects, uses, shares and stores personal information about clients and prospective clients, suppliers, artists, contacts and anyone else about whom we hold information. "You" means the person the information is about.
Who we are

What we collect
- your name and contact details, such as your address, email address and telephone number;
- information about works of art you have bought, sold, consigned or enquired about, and about your attendance at exhibitions and art fairs;
- correspondence with you by letter, email or telephone;
- where needed for a transaction, payment details such as your bank name, account number and sort code;
- where the law requires it (see "Anti-money laundering checks" below), proof of your identity and address, information about the source of the funds used in a transaction, and, for companies and trusts, information about their owners and controllers.
How we collect it
- from you directly: in person, in writing, by email or by telephone;
- when you buy or sell a work of art through us, or meet us at an exhibition or art fair;
- from publicly available sources and screening services, where we must carry out anti-money laundering and sanctions checks.
How we use it, and our legal basis
- to carry out a purchase, sale or consignment you have asked for (performance of a contract, or steps you have asked us to take before one);
- to meet our legal obligations, including anti-money laundering, sanctions, tax and accounting requirements (legal obligation);
- to answer your enquiries and keep proper business records (our legitimate interests in running the gallery);
- to send you news of our catalogues and exhibitions, where you have agreed to this or are an existing client (consent or legitimate interests; you can opt out at any time).
Anti-money laundering checks
As a dealer in works of art, we are an art market participant under the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017, and are supervised by HM Revenue & Customs. For transactions at or above the value set by those Regulations, we must verify the identity of our clients and of the people who own or control them, understand the source of funds, and check sanctions lists.
Information collected for these checks is used only to prevent money laundering and terrorist financing, unless another law allows or requires a different use. We may be required by law to report suspicions to the National Crime Agency, and we may not be permitted to tell you that we have done so.
Who we share it with
We do not sell your personal information. We share it only where necessary:
- with HM Revenue & Customs, the National Crime Agency, the police, courts or other authorities where the law requires us to;
- with our professional advisers, such as accountants and lawyers;
- with shippers, framers, restorers, insurers and art fair organisers, where needed to deliver a service you have asked for;
- with the providers of our email, website hosting and IT services, who act only on our instructions.
Transfers outside the UK
Some of our service providers, and some art fairs and exhibitions we take part in, are outside the UK. Where personal information is transferred outside the UK, we make sure it is protected as UK data protection law requires, for example by transferring only to countries the UK recognises as adequate, or by using approved contractual safeguards.
How long we keep it
- anti-money laundering records: five years from the end of our business relationship with you, or from the completion of a one-off transaction, after which they are deleted unless the law, legal proceedings or your consent require otherwise;
- transaction and accounting records: for as long as tax law requires;
- marketing contact details: until you ask us to stop, after which we keep only what we need to respect your wishes;
- other correspondence: only for as long as it is needed for the purposes above.
Your rights
Under UK data protection law you have the right to:
- ask for a copy of the personal information we hold about you;
- ask us to correct information that is inaccurate or incomplete;
- ask us to delete your information, or to restrict how we use it;
- object to our use of your information based on legitimate interests, and to direct marketing at any time;
- withdraw your consent where we rely on it;
- ask for information you gave us to be transferred to another organisation.
Some of these rights are limited where we must keep information by law, for example anti-money laundering records. To use any of your rights, please email info@martyngregory.com. We will respond within one month.
This website
This website has no forms, does not use cookies and does not use analytics. Our hosting provider processes technical information, such as your IP address, in order to deliver the website securely. If you choose Simplified Chinese on the About page, your browser remembers that choice on your own device; it is not sent to us.
Security
We keep personal information secure with appropriate physical, technical and organisational measures, and limit access to those who need it.
